Ms. Cheryl Ann L. Peña has more than twenty years of solid experience in Labor and Employment Law, Family Law, and Litigation. She manages a diverse clientele composed of domestic, foreign and multi-national corporations engaged in various industries, such as aviation and aerospace, knowledge and business process outsourcing (BPO), food and beverage, advertising and marketing, information technology, telecommunications, agriculture, and consumer manufacturing and retail.
Ms. Peña regularly advises clients on day-to-day human relation management concerns, labor standards and benefits, employment termination and discipline, outsourcing arrangements, and reduction in force and “right-sizing” programs. She is proficient in drafting and revising employment contracts, employee handbooks, and codes of discipline, and service agreements, to ensure legal compliance and adaptability to the objectives of the business. She delivers lectures and seminars on social legislation, labor relations, labor standards, and mandatory workplace policies.
Ms. Peña also has a robust experience in successfully defending clients in labor arbitration proceedings and appeals involving wrongful termination suits and employment-related money claims. She acted as counsel for the BPO employer in Jacolbe v. Telephilippines, Inc., which was decided by the Supreme Court in favor of the employer, and is now cited as the landmark ruling on dismissal arising from failure to meet Performance Improvement Plans (PIP).
Ms. Peña’s Family Law practice involves representing clients in adoption proceedings and petitions for dissolution of marriage. She also represents clients in estate settlement proceedings and assists in drafting wills and extra-judicial settlement agreements.
Prior to becoming one of the founders of KMAPS Law, Ms. Peña was a Partner at one of the oldest law firms in the Philippines.
